Within the scope of this Preliminary Information Form, the Buyer is informed about the details of his order, and the Buyer is required to approve the distance sales contract in accordance with the Distance Contracts Regulation regarding the electronic purchase of goods or services. However, after the Buyer's order and payment steps are completed, the Buyer cannot change the details of the order. The Preliminary Information Form and Distance Sales Agreement are recorded by the Service Provider for the period stipulated in the legislation, and the Buyer will be able to access the texts from the 'Distance Sales Agreement' page at any time during this period.

TERMS OF DELIVERY: 

The provision of the delivery service shall commence within 7 working days following the ordering of the goods or services by the Buyer.

The service fee in question is collected from the buyer by the service provider on behalf of the seller within the scope of the payment protection system. By paying the price of the goods / service to the service provider, the buyer will be deemed to have paid the product price to the seller.

RIGHT OF WITHDRAWAL

The Buyer may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery in transactions related to the sale of goods / services and within 14 (fourteen) days from the date of purchase in transactions related to the sale of services, without any legal and criminal liability and without any justification. The buyer may also exercise the right of withdrawal within the period until the delivery of the goods / services.

The buyer can exercise his/her right of withdrawal by sending an informative e-mail to customercare@naiaistanbul.com. The Buyer must send the goods back / notify the request to stop the service purchase within 10 (ten) days from the date of exercising the right of withdrawal by specifying the order number to the relevant e-mail address, taking the seller's return address information. Together with the goods, the invoice, the box, packaging, standard accessories, if any, and other products gifted with the goods must be returned complete and undamaged. 

The Buyer can send the goods to be returned to the Seller by any cargo company, the return shipping cost belongs to the Buyer. The Seller is not responsible for the return shipping cost and damage to the goods during the shipping process.

Within 14 (fourteen) days from the Buyer's exercise of the right of withdrawal, all payments made by the Buyer to the Seller or Service Provider for the relevant goods or services shall be refunded to the Buyer in a single payment in accordance with the payment instrument used by the Buyer when purchasing and without any cost or obligation to the consumer. For purchases made using credit, in cases where the right of withdrawal is duly exercised, the product price will be returned to the account associated with the credit.

In the event that there are justifiable reasons for the goods not to be returned / service not to be stopped, the Seller may supply goods / services of equal quality and price to the Buyer before the performance period in the contract expires. If the Seller thinks that the performance of the goods / services has become impossible, it notifies the Buyer within 3 (three) days from the date it learns of this situation. In this case, the Seller shall return the paid price and documents, if any, to the Buyer within 14 (fourteen) days. The Seller is not responsible for the return shipping cost and any damage to the goods during the shipping process.

CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

In accordance with the legislation, the Buyer cannot exercise the right of withdrawal in the following cases:

Contracts for goods or services whose prices are subject to fluctuations in financial markets and are not under the control of the Seller (e.g. jewelry, gold and silver products);

In the case of made-to-order products that are prepared in accordance with the wishes of the Buyer or explicitly in line with his/her personal needs and are not suitable for return due to their nature;

In contracts for the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; in contracts for the delivery of goods whose return is not suitable in terms of health and hygiene;

Contracts for goods that are mixed with other products after delivery and cannot be separated due to their nature;

Contracts for the delivery of periodicals such as newspapers and magazines other than those provided under a subscription agreement;

In contracts for services whose performance is started with the consent of the consumer before the expiration of the right of withdrawal period; and

In contracts for services performed instantly in electronic media and contracts for intangible goods delivered to the consumer instantly (gift cards, gift vouchers, money substitute coupons and the like).

The right of withdrawal cannot be exercised in respect of goods or services that are excluded from the scope of the Distance Contracts Regulation.

DISPUTE RESOLUTION

Under the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, the responsibility for the goods or services sold personally belongs to the Seller. However, Buyers may submit their complaints about the goods and services they have purchased to the Sellers directly or through the Service Provider. If the complaint is forwarded to the Service Provider, the Service Provider will provide all possible support to resolve the problem.

In case of disputes regarding this Agreement; Turkish Law is valid and Istanbul (Central) Courts and execution offices are authorized.

ARTICLE 2- SUBJECT 

The subject of this contract is the determination of the rights and obligations of the parties regarding the order given electronically by the BUYER via the SELLER's website www.naiaistanbul.com and detailed below, within the scope of the Law on the Protection of Consumers dated 7/11/2013 and numbered 6502 and the provisions of the Distance Contracts Regulation dated 27/11/2014 and numbered 29188. 

ARTICLE 3- CONTRACTUAL PRODUCT

3.1. The type and type, quantity, basic characteristics, brand, model, model, color of the products are as stated above and this information has been selected and approved by the BUYER.

3.2. The shipping fee for the relevant products is paid by the SELLER.

ARTICLE 4- GENERAL PROVISIONS

4.1. The BUYER declares that he / she has read and informed the preliminary information regarding the basic qualities, sales price and payment method and delivery of the product subject to the contract that he / she has received from the website www.naiaistanbul.com in this contract and that he / she has given the necessary confirmation electronically.

4.2. The product subject to the contract shall be shipped for each product within the term specified on the page of this website, depending on the distance of the BUYER's location and as described in the pre-information form on the website, and will be delivered to the BUYER or the person/organization at the address he/she indicates. However, the SELLER cannot be held responsible for late deliveries due to the problems that the Cargo Company may face during the delivery of the Products to the BUYER.

4.3. If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER shall not be held responsible for the refusal of the person/organization to be delivered. 

4.4. The SELLER is responsible for the delivery of the contracted product in accordance with the robust, complete, orderly qualifications.

4.5. For the delivery of the product subject to the contract, it is imperative that the signed copy of this agreement has been delivered to the SELLER and that the price must be paid in the payment form preferred by the BUYER. If for any reason the product price is not paid or cancelled in the bank records, the SELLER shall be deemed free of the obligation to deliver the product.

4.6. If the relevant bank or financial institution does not pay the product price to the SELLER due to the unfair or unlawful use of the buyer's credit card by unauthorized persons due to the defect of the BUYER after the delivery of the product, the product must be sent to the SELLER within 3 days provided that the BUYER has been delivered to him. In this case, the transportation costs belong to the BUYER. 

4.7. If the SELLER cannot deliver the contracted product within the period due to force majeure or emergency situations such as interruption of transportation, the air opposition is obliged to inform the BUYER of the situation. In this case, the BUYER may use one of the rights to cancel the order, replace the contracted product with a precedent, and/or postpone the delivery time until the blocking situation disappears. If the BUYER cancels the order, the amount paid to him or her within 10 days will be paid to him or her in the name.

4.8. The Seller is obliged to report this situation to the BUYER before the expiry of the performance obligation arising from the contract and return the total price to the BUYER within a 10 (ten) day period if the delivery of the Products becomes impossible.

ARTICLE 5- RIGHT TO WITHDRAWAL AND CHANGE 

5.1. In order to process your return and exchange requests for NAIA ISTANBUL branded products belonging to the SELLER, the relevant products must be delivered to the official address of the NAIA written on this website within 14 business days from the date of delivery and the change /return request must be notified to NAIA in writing. For products specially prepared in accordance with the wishes of the buyer, the buyer shall be charged under section 48/4 of the Consumer Protection Law No. 6502. It accepts that it has waived the right of withdrawal specified in article 29188 and the return of these products is not possible in accordance with Article 15.b of regulation No. 29188.

5.2. The buyer's rights arising from the law regarding defective products are reserved and the BUYER is obliged to inspect the product at the time of delivery of the products and to notify the SELLER immediately of the defects it detects.

ARTICLE 6- COMPETENT COURT 

In the implementation of this agreement, the Consumer Issues Arbitral Tribunal or the Consumer Court in Istanbul or the buyer's settlement is authorized within the monetary limits set by.C the Ministry of Industry and Trade in December each year.

In the event of an order, the BUYER shall be deemed to have accepted all the terms of this agreement.
